Exploring the UNCITRAL-ICSID Code of Conduct for Adjudicators

The Program

The UNCITRAL-ICSID Code of Conduct is now in its third draft, and important questions remain regarding the question of how many hats an arbitrator can wear.

In this interactive session, the panel considers the challenges of double-hatting in international arbitration, and particularly investor-state dispute settlement as discussed in Working Group III. We begin with a historical overview of the Code and its evolution. We then turn to the issues that surround multiple roles — e.g., independence, impartiality, appearance, lack of clarity, and issue conflict, etc. The current text of the Code presents 3 options to limit multiple roles. Do these represent the collective views of all stakeholders? Will the Code receive widespread adoption and a resulting change in behavior within our community Please come ready with questions.
