While the ethical conduct of parties and their counsel in arbitration proceedings is essential to the legitimacy of the arbitral process, its regulation remains a contentious issue. As the field has grown, some arbitral stakeholders have called for arbitral tribunals to take primary responsibility to regulate ethical conduct that threaten the fairness of the arbitral proceedings. Others have argued arbitration’s success rests on the absence of regulation or that this role should not fall to arbitrators, who are selected by parties to decide the dispute. These issues and more will be considered in what promises to be a thought-provoking debate on ethics in international arbitration.
