NYIAC’s 12th Grand Central Forum: International Sports Arbitration – Is it International Arbitration?
This session examines the nature and essence of arbitration (domestic and international) through the prism of sports arbitration. The panelists will explore whether sports arbitration is properly considered as falling within the rubric of “classic” arbitration or whether it is better understood as a distinct regime shaped by private ordering, public regulation, or sports governance.
The recent unsuccessful certiorari petition to U.S. Supreme Court in Flores v. NFL highlights some of the distinctive aspects of sports arbitration. That case leads to a discussion of similar issues in the international context — international sports organizations and tournaments (e.g., FIFA, The Olympic Games, etc.), where arbitration is not just a private dispute mechanism but a governing structure built into the rules of participation.
