The Program
In this dynamic session, practitioners will share global perspectives on sovereign immunity in relation to award enforcement and burden of proof, stocktaking on topics including:
- current approaches to intra-EU investment arbitration after Achmea;
- constitutional developments from Latin American states and pre-empting immunity issues through waiver;
- infrastructure projects and political risk in key African jurisdictions;
- offshore jurisdiction in key Asian jurisdictions; and
- defending against enforcement in the U.S.
