In April 2018, a Working Group of the International Council for Commercial Arbitration (“ICCA”), the International Institute for Conflict Prevention and Resolution (“CPR”) and the New York City Bar Association (“NYC Bar”) published a Draft Cybersecurity Protocol for International Arbitration for comment (“Consultation Draft”). Through an extensive consultation process that included workshops held around the globe, the arbitration community conveyed wide support for the Working Group’s initiative and provided thoughtful comments on the Consultation Draft. At this seminar, members of the Working Group will present the revised 2020 Cybersecurity Protocol for International Arbitration (the “Protocol”) and share insight on how parties and arbitrators can use the framework provided by the Protocol to determine reasonable cybersecurity measures for their arbitrations.
