The Program
The book offers a unique perspective on the role of national courts when dealing with arbitral jurisdiction under the UNCITRAL Model Law. It examines and discusses the timing of judicial determination of jurisdictional challenges in the presence of an arbitration agreement. The controversy it addresses is whether national courts should (or could) conclusively decide arbitral jurisdiction before or after the arbitrators have preliminarily determined that issue. Therefore, the book’s core discussion is a matter of timing – a “when” question.

Most authorities have answered the “when” question in binary terms (prima facie or full review). This book presents a fresh perspective and framework for approaching legal interpretation in the context of the UNCITRAL Model Law, specifically when dealing with “early determination of arbitral jurisdiction”.
