The Program
For many years, the UN was the main institution leveling sanctions against certain individuals and/or states. In recent years, that dynamic has shifted, from a multilateral sanctions regime to a peppering of unilateral sanctions regimes.
Building on a NYIAC Program held in 2023, this session brings together perspectives from an eminent arbitrator, seasoned practitioners in the national security, sanctions and international arbitration fields, and representatives from the LCIA and ICC. It offers a panoramic overview of major economic sanctions policy-related developments since 2023, canvassing the expansion of secondary sanctions regimes, the defensive use of counter sanctions, export controls and anti-arbitration injunctions, and the increasing friction between certain national policies vis-à-vis arbitral award enforcement policies.
The panel will consider how such developments have continued to impact the international arbitration landscape, exploring the implications for pre-dispute risk mitigation, arbitral seat selection, the conduct of an international arbitration, management of parallel proceedings and interim relief applications (including anti-suit injunctions and security for costs), and attempts to enforce arbitral awards against, and conversely by, sanctioned parties.. The panel will also debate what the increasingly dense web of sanctions and export controls means for the notion of access to justice, including as to the perceived benefits of neutrality and impartiality of the arbitral forum by comparison to other dispute resolution forms more anchored to a particular domestic locality.
