Construction litigation lives or dies on the ability of a lawyer to translate complex engineering concepts into compelling legal arguments and the ability of an engineer to withstand the crucible of Daubert and cross-examination. This 90-minute interactive seminar brings together two seasoned construction litigators and two veteran forensic engineers to deconstruct the best practices for building, managing, and deploying expert witnesses. The panel will discuss design defects, construction means/methods, and the intersection with personal injury/ADA claims unspoken rules of information exchange, the three documents every engineer need before trial, and how to avoid the catastrophic failure of a “surprised” expert on the stand. The panel will be held with the Association for the Advancement of Cost Engineering International at the American Arbitration Association in New York City.
